Due Process

 

              YOU HAVE THE RIGHT TO KNOW ABOUT SERVICES THE COUNTY BOARD PROVIDES. 

 

You may want to ask: 

  • Do you have something I can read or show someone that tells about county board services?
 
  • If eligible, how will it be decided what services I can receive?
 
  • If it is determined that I need assistance, how will the county board help me:
      • -Work with my school district
      • -Find respite care
      • -Bank and shop
      • -Find a job or a place to live
      • -Find transportation to my job
      • -Find services from other agencies 

             

                  YOU HAVE THE RIGHT TO RECEIVE SERVICES AND BENEFITS FROM OTHER AGENCIES ALONG WITH COUNTY BOARD SERVICES. 

             

              YOU HAVE THE RIGHT TO APPEAL DECISIONS MADE BY THE COUNTY BOARD. 

                           

                 Q: WHO CAN APPEAL? 

             

                        A: A person over the age of 18 who is applying for or receiving services from a county board, the parent of a minor, or the guardian of a child or adult 

 

You may want to ask: 

  • What is an appeal?
  • How do I appeal?
  • How long will it take?
  • Will it cost me any money to appeal?
  • How do I get information that tells me how to appeal?
  • May I have someone help me appeal?
  • Will my services remain the same during the appeal?
 

              If found ineligible, you have the right to appeal the eligibility determination. 

 

You may want to ask: 

  • How was the eligibility determined?
  • When will I receive my copy of the COEDI/OEDI or other reports or instruments used to determine my eligibility?
 

              You have the right to appeal a decision made to reduce the services you receive. 

 

You may want to ask: 

  • Why does the county board want to reduce my services?
  • When will I receive a copy of the information used in the decision used to reduce my services?
 

              You have the right to appeal a decision to stop your services. 

 

You may want to ask: 

  • Why does the county board think I no longer need this service?
  • When will I receive a copy of the information used to stop my services?

 

              YOU HAVE THE RIGHT TO RECEIVE SERVICES IN THE ORDER IN WHICH YOUR NAME APPEARS ON THE WAITING LIST, EXCEPT IN SITUATIONS THAT ARE CONSIDERED EMERGENCIES 

 

You may want to ask:

  • What is an emergency?
  • Where is my name of the list and how long will it take for me to get services?
  • What will happen when my name comes up on the list?
  • If I want more than one service, will my name on more than one list?
  • What will happen if my name comes up in the list and I do not want the service, or I am not ready for the service?


 

              YOU HAVE THE RIGHT TO HAVE A PERSON(S) OF YOUR CHOICE HELP YOU DURING ANY APPEAL PROCESS. 

 

You may want to ask:

  • Who can help me?
  • How can I find someone to help me?
  • How will the county board provide someone to help me? 

     

              YOU HAVE THE RIGHT TO SEE RECORDS THE COUNTY BOARD KEEPS ABOUT YOU AND TO GIVE PERMISSION IF THEY WANT TO SHARE IT. 

 

You may want to ask:

  • What is considered personal information?
  • Who is allowed to see my personal information and how are they able to obtain it?
  • How do I get a copy of my records?
  • Is there a charge for copies?
  • What form do I complete to approve sharing my information with other agencies?
